Chemical Watch reports on Only Representative worries

Concerns over the rules around 'Only Representative' look to be growing for companies outside the EU.

Mixed guidance and contradictory statements have led to many questions arising. In their article, the Chemical Watch report the areas where US firms hold particular fears. These include:
  • who should be appointing the OR in the first instance
  • the extent of the supply chain covered by the OR and
  • the worth of appointing an OR, when the OR is required to register an aggregate substance volume for all companies it represents thus a company below the threshold for registration could be swept in.
At the joint Commission / European Chemicals Agency (ECHA) conference held earlier this week in Brussels, Otto Linher has announced a new interpretation to this last point whereby appointed ORs will have to submit separate registrations for each company they represent.
